§ 1. General Provisions

These Terms of Service define the rules for using the online store available at www.esim.com.pl, including the rules for concluding sales agreements for digital products (eSIM cards), order processing, payments, delivery, and complaint handling procedures.

The owner and administrator of the Service is TECHMOBILE Sp. z o.o., with registered office at ul. Lwowska 10/36, 00-658 Warsaw, entered in the National Court Register under KRS number 0001221514, NIP: 7011297579, REGON: 543888031. Contact: [email protected].

Definitions used in these Terms:

Service Provider / Seller - TECHMOBILE Sp. z o.o.
Customer / User - a natural person, legal person, or organizational unit without legal personality using the Service.
Consumer - a natural person performing a legal action with an entrepreneur not directly related to their business or professional activity.
eSIM - a digital SIM card (profile) enabling mobile data services in operator networks, sold on a prepaid basis.
Service - an electronically provided service consisting of delivering an eSIM profile and a data package.

§ 2. Technical Requirements and Compatibility

To use the Service and purchase an eSIM, the following are required:

A device with internet access and a web browser.
An active email address.

IMPORTANT: The Customer acknowledges that using the purchased eSIM requires a mobile device that: (a) supports eSIM technology (has a built-in eSIM module), and (b) is not SIM-locked (unlocked for any operator).

Before purchasing, the Customer is obliged to verify device compatibility. The responsibility for verification lies with the Customer.

§ 3. Acceptable Use Policy

The Customer must use the Service in accordance with law and good practices.

Prohibited:

Providing unlawful content.
Using eSIM services for illegal activities, fraud, artificial traffic generation, or network security breaches.
Reselling purchased services to third parties without written consent.

The Service Provider reserves the right to suspend or block access upon detecting abuse.

§ 4. Contract Conclusion and Order Processing

Product information on the website constitutes an invitation to conclude a contract under Art. 71 of the Polish Civil Code.

To conclude a contract, the Customer: (1) selects a data package (country/region, data amount, validity), (2) fills out the order form (as guest or registered user), (3) accepts these Terms of Service, and (4) makes the payment.

The sales contract is concluded upon successful payment. The product is delivered instantly via electronic means - a QR code and installation instructions are provided by email or through the user panel.

§ 5. Prices and Payments

Prices are gross (including VAT if applicable) in the currency shown (PLN, EUR, USD).
Payments are processed by external operators (Stripe, PayNow, Apple Pay, Google Pay).
We do not store full payment card data - processed directly by the payment operator.
Invoices are available in the user panel or sent to the email provided.

§ 6. Right of Withdrawal (Returns)

Under Art. 38 of the Polish Consumer Rights Act, the right of withdrawal does not apply to digital content not supplied on a tangible medium if performance began with the Consumer's express consent before the withdrawal period expired.

In practice: Due to the nature of the product (digital code), after the QR code is sent and/or the eSIM installed, a return is not possible.

By purchasing and requesting immediate delivery, the Customer consents to the loss of the right of withdrawal.

In the event of a refund for a transaction made by the Customer using a payment card, the Seller shall refund the amount to the bank account linked to the Customer's payment card.

The Seller shall refund the payment using the same payment method used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not involve any costs for them.

§ 7. Complaints and Quality Guarantee

The Service Provider is responsible for conformity of the service with the contract.

You may claim a refund if:

The eSIM doesn't work due to a technical error on our side.
The QR code is invalid or damaged.

Complaints are not accepted when:

Your device doesn't support eSIM or is SIM-locked.
You deleted the eSIM profile after installation (single-use).
You enabled roaming on the wrong SIM card.
No coverage due to local infrastructure limitations.

Complaints should be sent to [email protected] and include: order number, problem description, and phone settings screenshots. Processing time: up to 30 days.

§ 8. Liability

TECHMOBILE Sp. z o.o. sells telecommunications services provided by global partners. We strive for the highest quality but do not guarantee uninterrupted network availability worldwide.

For non-Consumer customers, warranty liability is excluded and compensation is limited to the order amount.

§ 9. Personal Data Protection

The administrator of personal data provided by the Buyer while using the Store is the Seller. Detailed information regarding the processing of personal data by the Seller – including other purposes and legal bases for processing, as well as data recipients – can be found in the Privacy Policy available in the Store, in accordance with the principle of transparency set out in the General Data Protection Regulation of the European Parliament and of the Council (EU) – "GDPR".

The purpose of processing the Buyer's data by the Seller, provided in connection with purchases in the Store, is the fulfillment of orders. The legal basis for personal data processing in this case is: the sales contract or actions taken at the Buyer's request aimed at concluding it (Art. 6(1)(b) GDPR), the Seller's legal obligation related to accounting (Art. 6(1)(c) GDPR), and the Seller's legitimate interest consisting in processing data for the purpose of establishing, pursuing, or defending potential claims (Art. 6(1)(f) GDPR).

Detailed personal data processing rules are defined in the Privacy Policy (available at /privacy), which is an integral part of these Terms.

§ 10. Final Provisions

Polish law applies to matters not regulated herein, particularly the Civil Code and Consumer Rights Act.
Disputes shall be resolved by competent courts under the Code of Civil Procedure.
Consumers may use out-of-court dispute resolution, including the ODR platform: ec.europa.eu/consumers/odr.
We reserve the right to amend these Terms. Orders placed before amendments are subject to the version in force at the time of placing the order.
